Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Ron Grattan, Vice Chairman  in Meeting Room A on the second floor of the Town Hall.

Appointments

7:30 PM with Don Ellis to discuss cleaning out the brook at the Old Mill across from the Town Hall.  Mr. Ellis informed the Board that a post supporting the sluiceway for the dam is broken and needs to be replaced.   Also, a lot of accumulated brush has to be cleaned out.  The issue is who is responsible.  The Conservation Commission is leasing the property and therefore, Mr. Ellis believes they are responsible for making this part of an ongoing maintenance program.  Ms. Cassady recommended that Mr. Ellis file a Request for Determination as he is the current owner.  Ms. Cassady will read the lease and make a recommendation as to what should be done for the next meeting.  

Public Hearings

7:45 PM  Notice of Intent for partial construction of dwelling, driveway, well and site grading within the 100’ buffer zone at 90 Pratt Place, Assessor’s Map 89, Lot 1 with Christine Fiske, owner, her mother, Regina Robbins and C.W. Garvey Co., Inc., 36 West St., Whitman, MA  (DEP #175- 411)

The notice was read and the green cards were checked.  Mr. Carlton Garvey presented plans for a proposed single family house.  Part of the driveway is in the 50-foot buffer zone and would have to be moved.  There is also a small isolated wetland on the property that Ms. Cassady would like certified as a vernal pool.  Abutters were asked for comments.  Henry and Karen Kennedy of 293 Gorwin Drive questioned whether the remainder of the land will be developed.  Mr. Garvey answered that the parcel will be sub-divided eventually.  Ms. Cassady asked about the perennial

stream that is shown on the USGS map but not shown on the plan.  Mr. Garvey thought that it was an intermittent stream.  Ms. Cassady would like to investigate as to whether there could be a riverfront area.  A site visit will be scheduled.

8:00 PM  Request to Amend an Order of Conditions to remove a chain link fence around a detention basin at Tag Way with Sheila Niksa, owner.  (DEP #175-341)

The notice was read and the green cards were checked.  Ms. Cassady, Craig Nicholson and Amy Gardner had made a site visit at this property on Sunday,  October 12th.  Ms. Cassady recommended that the Board make a decision based on whether or not it will impact the wetlands.  Mr. Grattan asked for a consensus.  All were in agreement that the fence could come down.   Mr. Grattan asked for comments from abutters.  There were none.

* Mr. Jim Hobbs, who is an abutter spoke up after the vote had been taken and wanted it noted in the record that he questioned changing the original Order of Conditions.  Sheila Niksa offered to plant dense evergreens or other suitable plantings around the detention pond to appease concerns from two abutters that did not state their names who had concerns about children playing near the pond.

8:15 PM   Notice of Intent for construction of an approximately 910-foot long, 26-foot wide, paved roadway with a storm drainage system at Brook St., Edgewood Estates, Map 96, Lot 15 with R & C Realty Trust, 305 Brook St. (DEP #175-412)

The notice was read and the green cards were checked.  Mr. Bernard Munro representing R & C Realty presented plans for a proposed roadway for a 7- lot subdivision.  There will be a future filing for each lot.  Ms. Cassady had received a memo from the Planning Board showing the retention pond was in the buffer zone.  However, nothing is in the 50-foot buffer.   A 10-foot easement shown on the plan has been granted to the Town of Hanson for access to Conservation Land that abuts the development.  Abutters were asked for comments.  One abutter was present but had no questions and did not state his name.

8:45 PM  Request to Amend an Order of Conditions for permission to install four (4) sets of piezometers within the Bordering Vegetated Wetland at the Crystal Springs Well site off Main St., Map 45, Lot 12A with CDM, 50 Hampshire St., Cambridge, MA representing the Town of Hanson Water Department (DEP #175-372)

The notice was read and the green cards were checked.  Greg Jason and Ben LaVeque of CDM made a presentation as to where the piezometers were going to be located.  A slide hammer will be used to drill the holes.  This will be done by hand.  Ms. Cassady said that no heavy equipment should be used.  They agreed.  Also, Ms Cassady would like a copy of the wetland monitoring plan.

Orders of Conditions/Determinations of Applicability/Certificates of Compliance

Order of Conditions for Lot 8, Litchfield Lane, Stonewall Estates, with Grady Consulting, LLC, 39 Pond View Drive, Kingston, MA for construction of a single-family dwelling  (175- 409) with special conditions: 1. Prior to the start of work, a single row of double staked haybales and silt fence shall be installed as shown on approved plans. 2.There shall be a double row of double staked haybales around the well site.3. After all of the haybales and silt fence have been installed, an appointment for an inspection shall be made with the Conservation Department prior to the start of work.4. After work is complete, the area shall be loamed and seeded with grass. 5.  Once the area is stabilized with grass, the haybales and silt fence shall be removed.

Negative Determination of Applicability (DOA) for 42 Greenbrier Lane, Assessor’s Map 108, Lot 41 for a repair of a septic system with Grady Consulting, LLC with special
orders: 1.  A single row of dbl.staked haybales w/silt fence shall be placed onsite as shown on appr.plans.2.  After the haybales & silt fence are installed, a site insp. shall be scheduled w/ the ConCom.3.  After the system is installed, the area shall be loamed & seeded to stabilize all slopes and reduce impact to the wetland.  4.  Haybales & silt fence shall be removed after the grass is grown in and stabilized.

Orders of Conditions for construction of a single family dwelling on Lot 6, Proudfoot Way, Stonewall Estates with Grady Consulting, LLC,    (DEP #175-410) with special conditions: 1.  Prior to the start of work, a single row of dbl. staked haybales and silt fence shall be installed as shown on appr. plans.2.  There shall be a dbl. row of dbl. staked haybales around the well site.3.After the haybales and silt fence have been installed, an appt. for an inspection shall be made with the ConCom prior to the start of work. 4.A French Drain shall be placed along the side of the DW with crushed stone.5. After work is complete, the area shall be loamed and seeded with grass. 6.Once the area is stabilized with grass, the haybales and silt fence shall be removed.

Negative Determination of Applicability (DOA) for the paving of Wellfield Rd. (also known as Crystal Springs Wellfield) off Main St., Assessor’s Map 45, Lot 12A, Glen Doherty, Superintendent of the Hanson Water Department with special orders:  1.  A single row of dbl.staked haybales shall be placed prior to the start of work along either side of the driveway.  2.  Silt fence shall be installed along the Poor Meadow Brook.  3.  After the haybales & silt fence are installed, a site inspection shall be scheduled w/ the ConCom.  4.  There shall be no re-grading of the exist.rdwy.5.  There shall be no removal of vegetation on the site.

Discussions

Ms. Cassady mentioned that she had spoken with Peter Jones, Selectman who suggested that a set policy be written and voted on regarding site visits and when it would be necessary to have someone accompany her, particulary for controversial issues.  

Summons to Superior Court Re:  Complaint brought by Elko Construction Corp. (Civil Action No. 03-1212):  Ms. Cassady will get in touch with Merry Scozzari, acting Executive Secretary to see if we should contact Town Counsel at this point in time.

Letter from BETA Group, Inc./Alan Hanscom, P.E., LSP regarding the initial Environmental Review of the Lite Control Property:  Ms. Cassady explained that Mr. Hanscom is missing information regarding a cleanup a number of years ago at the site and wants permission to do some sampling from the monitoring wells and also do some soil samples before acquisition of this land.  He wants to be sure that there are no issues with the property.  Mr. Grattan mentioned that this is a great wildlife habitat.

Ms. Cassady said that there might be an enforcement issue on Crooker Place regarding tree cutting.  She is sending a letter to the owner first.
